CELL PHONE ACCIDENT STATISTICS
The vast majority of Americans – 97 percent – now own some type of cellphone. The percentage of Americans who own a smartphone has risen to 85 percent
, up from 35 percent in the Pew Research Center's first survey of smartphone ownership in 2011.
Cellphones are owned by a sizable majority of Americans across a wide range of demographic groups. In contrast, smartphone ownership varies more depending on age, household income, and educational attainment.
Using a cell phone while driving increases the risk of fatalities and injuries on American roads. In 2019, 3,142 people were killed in car accidents caused by distracted drivers.
PROVING RESPONSIBILITY IN CELLPHONE AUTO ACCIDENTS IN DALLAS
It is often necessary to conduct a police investigation or an independent legal investigation to determine whether the driver who caused an accident was using a cell phone. Drivers may not readily admit to being on the phone or texting, but testimony from witnesses or phone records can prove this.
Our car accident lawyers routinely subpoena defendant drivers' cell phone records in order to establish civil liability in motor vehicle accidents.
THE LAW IN TEXAS REGARDING CELL PHONES AND DRIVING
Unless the vehicle is stopped, reading, writing, or sending electronic messages while operating a vehicle on a public roadway is a violation of Texas Transportation Code Section 545.4251. This section was added to Texas Transportation Code Section 545.425, which already prohibited the use of a cellphone or mobile device in a school zone. One exception to this rule is when you use it in a hands-free setting – that is, when you play with it in your hands.
Using an electronic device while operating a vehicle on public school property is also a violation of Texas Transportation Code Section 545.4252. This section was added because a school parking lot is not a public roadway. As a result, you are not permitted to use your mobile device while driving, even in a public school parking lot or anywhere else on school property.
When it comes to drivers under the age of 18, Texas Transportation Code Section 545.425 is even stricter. A driver under the age of 18 is not only not permitted to read, write, or send messages on a mobile device, but they are also not permitted to use a hands-free device.
